Schenkers vs Siemens landmark decision

Yesterday the High Court of Australia handed down it's decision in favour of Schenker and this result closes the book on one of the longest and most important court cases in this industry.  The decision is the first time that the highest court of law in any country has ruled on Clause 4 of the IATA / FIATA airwaybill and it now provides certainty for the Freight Forwarder when acting as 'Contracting Carrier' (when a Hawb is issued).  AFIF will be presenting more information on the ramifications of this outcome during State meetings and / or the the AFIF National Conference.  In addition this decision will be of great interest to FIATA and the rest of the Freight Forwarding world in ensuring that this clarity is expressed in the Airwaybill conditions.  This is a landmark decision not just for Schenker but for all Freight Forwarders. Peter McQueen of Blake Dawson Waldron was the defending lawyer and Schenkers indemnity insurers  were the 'TT club', whose tenacity to pursue this to the end should be duly recognised.    Mr Fritz Heinzmann, board member of Schenker & AFIF says "we ought to have had the status of carrier when we issued the 'House Airwaybill' and this ruling confirms it once and for all".

Sea Container Movement study -NSW

The Sea Freight Council of NSW (SFC) recently undertook a study to ‘map’ the land side movement of international shipping containers, to and from the ports of NSW. It also highlights freight and logistics issues associated with container transportation. The findings will now be used by the Council and its stakeholders to work with industry in identifying and assessing proposed actions to improving overall efficiencies along the supply chain. The Federation of Asia Pacific Aircargo Associations (FAPAA) will be holding its 31st Executive Council Meeting (ECM) immediately after the AFIF 2004 Conference - at the Radisson Resort on the Gold Coast (May23-25).  AFIF currently holds the position of Vice Chairman of the organisation and also provides the Secretariat services. If you want to know what is happening or contribute to discussions on matters affecting our region you are welcome to attend as observers and join in the networking and social functions. IMPORTANT TRAINING NOTES:

ALL SHIPPERS OF DG REQUIRED TO UNDERTAKE TRAINING

New CASA regulations, effective as of from Jan 1st 2004, include the requirement that ALL SHIPPERS of Dangerous Goods by Air also need to undertake appropriate training. Please advise those involved that AFIF can provide this training. The Govt will allow a six month moratorium after which this new rule will be strictly monitored.


Dangerous Goods By Air (Acceptance) Re-certification.

New laws allow you to re-certify in the period up to 3 months before your current certificate is due to expire, whilst retaining the day/month of expiry 2 years hence.  For example: If you have a certificate due to expire March 31st 2004, then re-certification training can be undertaken ANY time within January, February or March 2004 and your NEXT certificate will remain current until March 31, 2006. 

Shipper’s Responsibility for “Non Dangerous” Goods

As a reminder, forwarders must ensure that all shippers of good by Air sign a declaration to the effect that, where appropriate, shipments do not contain Dangerous Goods. This can be either by signing the Shipper’s Letter of Instruction (SLI) next to a specific question, or other form of forwarding instruction. However the question must be asked: “does this shipment contain Dangerous Goods, yes or no”.
